Circling TCG

Please read the following Terms and Conditions of Use ("Terms") carefully before using the website ("Site") and the application ("Platform"). Use of the Site and Platform is governed by these Terms, which are binding between the User and PERFECTROTATION LDA, a private limited company registered at Praceta Laura Alves, n.º 2, 3.º esquerdo, 2725-206 Algueirão-Mem Martins, registered under NIPC 519 451 309, owner of the Circling TCG brand (hereinafter "Circling TCG").

1. Domain and Ownership

The website www.circlingtcg.com and the Circling TCG application are the property of PERFECTROTATION LDA, a private limited company registered at Praceta Laura Alves, n.º 2, 3.º esquerdo, 2725-206 Algueirão-Mem Martins, NIPC 519 451 309, owner of the Circling TCG brand.

2. Purpose and Scope

These Terms and Conditions apply to all visitors and users of the website www.circlingtcg.com and the Circling TCG application, regardless of the plan subscribed (Free or PRO), the partnership level (Free, Premium or Founding Member), or affiliate status.

Circling TCG provides a Customer Support service through which users may at any time contact Circling TCG for clarifications, suggestions or complaints at support@circlingtcg.com.

Creating an account implies reading, understanding and accepting these Terms and Conditions.

3. Minimum Age

Use of the Platform is permitted only to users aged 13 or older.

If the user is under that age, use requires express authorisation from those holding parental responsibility, under applicable law.

Circling TCG reserves the right to suspend or delete accounts that violate this condition.

4. Nature of the Platform

Circling TCG is a digital platform for card collectors that allows users to organise collections, create wishlists and facilitate contact between users interested in making trades.

Circling TCG acts exclusively as a technological intermediary, providing tools that allow users to communicate and submit trade proposals. In this context, Circling TCG:

• Does not buy or sell cards;
• Does not intervene in negotiations between users;
• Is not a party to any agreement concluded between users;
• Does not process payments related to card trades.

Any agreement established between users results exclusively from their own initiative and responsibility. Users acknowledge that Circling TCG acts exclusively as a technological facilitator and not as a commercial intermediary.

5. User Plans: Free and PRO

5.1 Plan Description

The Circling TCG Platform offers two plans for individual users: a free plan ("Free") and a paid plan ("PRO"). The PRO plan unlocks advanced features for collection management, trading and user discovery, as described in the table below.

5.2 PRO Plan Subscription and Billing

The PRO plan is managed and billed through the Paddle platform (Merchant of Record), available in the following options:

• Monthly PRO: subscription with automatic monthly renewal.
• Annual PRO: annual subscription, paid in a single payment, at a discount versus the monthly plan.

5.3 Refund Policy

The user may request a full refund of the amount paid within the first 7 (seven) days after the initial subscription or after each renewal. Outside this period, no refund will be granted.

Refund requests must be sent to support@circlingtcg.com, indicating the e-mail address associated with the account and the billing date in question. The refund process is managed by Paddle as Merchant of Record.

5.4 Referral Programme (PRO Users)

Each user with an active PRO plan may generate a personalised referral link using their nickname. When a user subscribes to the PRO plan through another user’s link, the referring user receives additional PRO time, under the following conditions:

• Annual subscription referred: the referring user receives 4 (four) months of PRO immediately.
• Monthly subscription referred: the referring user receives 4 (four) months of PRO after 12 (twelve) consecutive monthly payments by the referred user.

The referral programme is subject to a maximum of 5 (five) referrals per user. Each user may only be referred once.

5.5 Affiliate Promotional Codes

The Circling TCG Platform may make available, within its Affiliate Programme, promotional codes (hereinafter "affiliate codes") that grant the user a discount on the PRO plan subscription, under the conditions defined for each code.

The use of an affiliate code is subject to the following rules:

• An affiliate code may only be used by a user who accessed the Platform through the referral link of the affiliate to which the code is associated — the system validates this condition before the payment process is opened;
• A user who has been referred by a given affiliate may not use the affiliate code of a different affiliate — the attempt is automatically blocked by the system before the payment process is initiated;
• A user without any affiliate referral may not use an affiliate code; in that case, the system displays the following message: "Partner codes are exclusive to referred users";
• Each affiliate code is strictly personal and non-transferable;

Circling TCG reserves the right to deactivate or change the conditions of any affiliate code at any time, without prior notice, without prejudice to discounts already granted.

6. Partnerships (Partners)

6.1 Programme Description

The Partners programme is aimed at physical TCG stores, event organisers and brands seeking visibility on the Circling TCG Platform. Three partnership levels are available, with different visibility benefits and features:

6.2 Partner Types

In addition to the partnership level, each Partner has a business type (informational only, with no impact on available features):

• Local store: local physical TCG store.
• Event: event organiser.
• Brand: brand or distributor.

6.3 Geographic Visibility

A Partner’s visibility on the Platform is determined by the country field (Partner’s country), and is by default visible only to users from the same country. If the "Is global" field is active, the Partner will be visible to all users on the Platform, regardless of country.

6.4 Partnership Terms and Management

Circling TCG reserves the right to suspend the participation of any Partner that breaches these Terms or the specific programme conditions.

6.5 Partner Disclaimer Regarding Trades Between Users

Partners join the Circling TCG Platform exclusively as entities with institutional visibility and, where applicable, as suggested venues for the physical meeting of users. This does not make them a party, participant or responsible for any trade agreement concluded between users.

Partners do not intervene in negotiations between users, do not verify the authenticity, condition or value of traded cards, do not mediate or guarantee compliance with any agreement, and do not process any payments or deliveries of goods in the context of trades.

Partners cannot be held liable for:

• Full or partial non-compliance with trade agreements between users;
• Defects, counterfeits, deterioration or loss of cards subject to trade;
• Fraudulent, deceptive or abusive conduct by users, even if those users used the Partner’s premises or were suggested to meet there;
• Any financial or non-financial damages suffered by users as a result of trade agreements.

Responsibility for trades lies exclusively with the users who enter into them. Using a Partner’s premises as a meeting point does not create any obligation of supervision, mediation or guarantee on the part of that Partner, nor does it imply their endorsement or approval of the agreement.

7. User-to-User Trades and Responsibility

Card trades are private agreements entered into directly between users. Circling TCG does not perform any prior verification of the authenticity or originality of the cards, their stated condition, the identity or reliability of users, or the truthfulness of information entered on the Platform.

The platform provides reputation mechanisms (a rating system) and reporting tools, but does not guarantee that trades will be completed. Users must act with prudence and responsibility, especially when making physical shipments of cards or agreements outside the application.

Circling TCG cannot be held liable for:

• Non-compliance with agreements between users;
• Losses, damages or misplacement of cards;
• Fraud, misleading conduct or misuse of the Platform by third parties;
• Any damages arising from trade agreements, even if concluded at a Partner’s premises or suggested through the Platform.

Responsibility for trade agreements lies exclusively with the users who enter into them. Circling TCG and Partners act, respectively, as a technological facilitator and as entities with institutional presence on the Platform, without implying any intervention, supervision or guarantee in relation to trades.

Without prejudice to the above, Circling TCG undertakes to review reports and to adopt reasonable moderation measures whenever it detects breaches of these Terms.

8. Market Value Information

The application may display indicative market values of the cards, based on data from external reference platforms. These values are for informational purposes only, do not constitute an offer to sell or buy, may vary frequently and depend on sources external to Circling TCG.

Circling TCG does not guarantee the accuracy or permanent up-to-dateness of these values, and users should confirm prices with the respective reference platforms if they intend to use them as a basis for negotiations.

9. User Conduct

By using the Platform, the user undertakes to:

• Provide true and up-to-date information;
• Act in good faith in negotiations;
• Respect other users;
• Not use the Platform for fraudulent, illegal or abusive purposes.

Circling TCG reserves the right to suspend or delete accounts that breach these Terms, namely in cases of fraud, manipulation of ratings, abusive behaviour or misuse of the application’s features.

10. Account Suspension and Cancellation

Circling TCG may suspend or delete accounts, temporarily or permanently, whenever:

• There is a breach of these Terms;
• There are indications of fraud or abusive behaviour;
• False information is provided;
• The account remains inactive for a prolonged period.

Account deletion may imply loss of access to associated data and content, including information relating to referrals and accumulated benefits from loyalty programmes.

11. Security and Data Protection

Circling TCG is committed to respecting the personal data of all users and to protecting the personal information provided, as set out in the Privacy Policy.

The collection and use of personal data complies with applicable data protection legislation, in particular the General Data Protection Regulation (GDPR), in order to ensure the confidentiality and security of the data provided.

Circling TCG reserves the right, without prior notice, to update security procedures, always in full respect of the rights of data subjects.

12. Intellectual Property

All content on the Platform, including brand, design, structure, features, logos and visual identity, is the property of PERFECTROTATION LDA, NIPC 519 451 309, or used with authorisation.

Reproduction, copying or unauthorised use of any Platform content is prohibited.

All text, images, and other materials related to the trading card games featured on this platform — including Pokémon TCG, Magic: The Gathering, Disney Lorcana, One Piece Card Game, Gundam War Nexus, Dragon Ball Super Fusion World, Riftbound, and Yu-Gi-Oh! — including card images, trademarks, and logos, are copyrighted or trademarked properties of their respective owners: The Pokémon Company, Wizards of the Coast LLC, Disney Enterprises, Inc., Bandai Co., Ltd., Riot Games, Inc., and Konami Digital Entertainment Co., Ltd.

Circling TCG is an independent application and is not produced, endorsed, supported, or affiliated with any of the aforementioned rights holders. Any references to their content are used for informational or reference purposes only.

13. Changes to Terms and Conditions

Circling TCG reserves the right to amend these Terms and Conditions at any time, including as a result of legislative changes, platform features or available plans and programmes. Changes take effect after notification to the user, which may be by e-mail or notice on the Platform. Continued use of the Platform after notification implies acceptance of the amended Terms.

14. Dispute Resolution

These Terms are governed by Portuguese law.

In the event of a dispute, the consumer may resort to an Alternative Dispute Resolution entity: Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC), available at https://www.cniacc.pt/.
